The ‘Centre’ refers to Melbourne City Baths (MCB). The ‘Customer’ refers to you.
You
The Customer is responsible for ensuring that the nominated account is able to accept direct debits. The Customer is responsible for notifying MCB of any changes to their banking details by completing a customer amendment form. Facsimile will not be accepted.
Direct debits
MCB will debit your nominated account for the amount and at the frequency as authorised and agreed by you on the membership application. If the nominated date of the direct debit falls on a public holiday or weekend, MCB will debit the account on the next business day. The Customer agrees to pay the direct debit at the agreed frequency until the membership is terminated in accordance with the FLEXI CANCELLATION and RESULTS CANCELLATION clauses. Direct debits can take up to seven days to appear on your bank account depending on your banks’ procedures.
Dishonoured payments
It is the Customers responsibility to ensure that funds are available in the nominated account. Should your payment be dishonoured, an additional $19.99 rejection fee will be charged to your outstanding direct debit amount. These fees will be required to be paid in full upon your next visit. In the event of payments being dishonoured on two consecutive occasions, MCB reserves the right to terminate your membership.
Suspending memberships
Memberships may be suspended in one week increments, and must be done so in advance. Suspensions will only take effect upon the completion of a customer amendment form or by emailing mcb@melbourne.vic.gov.au. Facsimile will not be accepted. In order to suspend payments the Customer is required to contact MCB at least seven days prior to the first day of suspension. The first four weeks of suspension in a calendar year are free after which the Customer will be charged $5.00 per week of suspension. All medical suspensions are free upon presentation of a valid doctor’s medical certificate.
Flexi cancellation
The Customer may cancel their membership by completing a customer amendment form or by emailing mcb@melbourne.vic.gov.au. It is the Customer’s responsibility to confirm the cancellation notification has been received and retain a copy of the cancellation communication. Facsimile will not be accepted. A period of one months written notice must be given and suspension cannot be used throughout this period. Should there be any arrears in payments the Customer authorises MCB to debit the outstanding balance in order to bring the account up to date, including a $19.99 rejection fee if applicable.
Results cancellation
The Customer may cancel their membership by completing a customer amendment form or by emailing mcb@melbourne.vic.gov.au. It is the Customer’s responsibility to retain a copy of the cancellation communication. Facsimile will not be accepted. A period of one month’s written notice must be given and suspension cannot be used throughout this period. A pro-rata for the duration of the membership remaining minus a $150.00 cancellation fee applies.
Damaged or lost wristband / card
Your membership wristband/card enables access to MCB facilities, lockers and self ticketing for Group Fitness. It is the Customer’s responsibility to ensure that your membership wristband/card is not damaged or lost. If the Customers’ membership wristband/card is damaged or lost, the Customer will be required to purchase a replacement membership wristband/card for $19.99.
Correspondence
It is the Customer’s responsibility to keep a record of correspondence (both written and electronic) between the Customer and MCB. Correspondence includes the membership application form, amendment forms, suspension or cancellation requests.
Reciprocal rights
Your chosen membership may entitle you to reciprocal rights to all four City of Melbourne facilities upon presentation of your membership wristband/card. To find out more, visit www.melbournecitybaths.com.au.
Operating hours
Management reserves the right to alter Centre operating hours as required. Operating hours can be viewed at www.melbournecitybaths.com.au.
Membership conditions
MCB reviews prices and operations annually, taking effect 1 July. Intended pricing changes are displayed in the centre from 28 May and written notice is sent to the Customer’s last known email address. It is the Customer’s responsibility to provide MCB with any change of personal details. In the event that the initial membership conditions are to change we will provide 30 days notice. Current membership conditions are displayed at www.melbournecitybaths.com.au.
Disputes
If you dispute any direct debit payment, suspension or cancellation you must notify MCB in writing within 30 days. It is the Customer’s responsibility to retain any such communication.
Liability
Despite foreseeable risks and the probability of serious harm, the burden of taking reasonable precautions to avoid the risk of harm lies with the Customer. These risks include, but are not limited to, loss or damage to personal property, injury or fatality. The Customer acknowledges and agrees that he/she uses the facility at his/her own risk. Also, if the Customer suffers injury or illness, the MCB and/or its staff or agents may arrange medical treatment as deemed essential for the safety of the Customer.
