                    Road discontinuance

                    City of Melbourne has the authority to approve the closure (discontinuance) of roads in the municipality and the subsequent sale of the land.

                    ​The discontinuance and sale of roads is carried out according to the provisions of Clause 3 of Schedule 10 of the Local Government Act 1989 and section 114 of the Local Government Act 2020. 

                    We have a Road Discontinuance and Sale Policy, which provides principles and guidance to ensure proposals are dealt with equitably and in a transparent and consistent manner.

                    We will investigate a road discontinuance where:

                    • An adjoining owner applies to discontinue a road by completing an application and emailing it to property@melbourne.vic.gov.au. Please refer to the explanatory notes for more information about road discontinuance and sale applications.

                    • City of Melbourne instigates a discontinuance in order to repurpose land, in many cases to include it with adjoining open space in a program known as Greening the city.

                    If a decision is made to discontinue a road and sell the land to an adjoining owner it will be sold at market value and all costs associated with the project will be paid for by the purchaser.
