Road discontinuance

City of Melbourne has the authority to approve the closure (discontinuance) of roads in the municipality and the subsequent sale of the land.

The discontinuance and sale of roads is carried out according to the provisions of Clause 3 of Schedule 10 of the Local Government Act 1989 and section 114 of the Local Government Act 2020.

We have a Road Discontinuance and Sale Policy, which provides principles and guidance to ensure proposals are dealt with equitably and in a transparent and consistent manner.

We will investigate a road discontinuance where:

  • An adjoining owner applies to discontinue a road by completing an application and emailing it to property@melbourne.vic.gov.au. Please refer to the explanatory notes for more information about road discontinuance and sale applications.
  • City of Melbourne instigates a discontinuance in order to repurpose land, in many cases to include it with adjoining open space in a program known as Green our City.

If a decision is made to discontinue a road and sell the land to an adjoining owner it will be sold at market value and all costs associated with the project will be paid for by the purchaser.
