Public precautions, report and consent

Find Report and Consent application forms and guidance for proposed demolition, alterations and construction of buildings and structures associated with your building permit application.

What is it?

If you want to conduct demolition, alterations or building works in the City of Melbourne you may be required to obtain a Report and Consent. 

The Report and Consent may be required for, but is not limited to:

  • Siting variations (Part 5 of the Regulations)
  • Projections beyond street alignment (part 6 of the Regulations)
  • Protection of public (regulation 116 of the Regulations)
  • Building over easement (regulation 130 of the Regulations)
  • Building in areas liable to flooding (regulation 153 and 154 of the Regulations)

When to apply

When you apply for a building permit, your Relevant Building Surveyor (RBS) will determine whether you need to get a Report and Consent of Council.

An architect or drafting person who prepares drawings for your building permit application can assist you in preparing the documentation required as part of your Report and Consent application.

If your design does not meet the requirements of Part 5 of the Building Regulations 2018, you will be required to apply for a siting variation.  
This may include a design for a:

  • Single Class 1 buildings and associated Class 10a buildings (carport, shed, garage)
  • Class 10b structures (fence)

You may need to apply for Report and Consent to construct a projection beyond the street alignment if your design does not meet requirements under part 6 of the Regulations for height or distance of projection. 
Projections beyond the street alignment include:

  • Architectural features
  • Window or balcony 
  • Verandah
  • Sunblinds and awnings
  • Service pipes, rainwater heads and service installations
  • Window shutters
  • Signs
  • Service cabinet doors
  • Any other part of the building

Protection of the public

You may need a Report and Consent before starting precautionary work to protect the safety of the public and public places under Regulation 116 of the Regulations.

Suitable precautions may include:

  • Hoardings
  • Gantries
  • Scaffolding
  • Exclusion zones

NOTE: If your demolition, alterations or building work require a Construction Management Plan (CMP), you will need to submit a Regulation 116 Report and Consent. CMPs will not be processed prior to the issue of a Report and Consent for public protection.  Apply for report and consent for protection of public

In order to construct a building over an easement you will need to apply for a Report and Consent under Regulation 130 of the Regulations.

If you are constructing a building in areas liable to flooding or on designated land or designated works, under Regulations 153 and 154 of the Regulations the Report and Consent of Council must first be obtained.

Prior to stormwater drainage works, you must apply for a legal point of discharge. This is also known as a Regulation 133 approval.

Fees

If your application relates to public precautions, the fee is $325.

For all other matters to report on the fee is $320.20.
