                    Amendment C323: Melbourne Arts Precinct

                    Amendment C323 seeks to introduce planning controls to encourage the provision of arts and creative industry along Sturt Street, Southbank in order to support the Melbourne Arts Precinct.

                    ​About the amendment

                    The City of Melbourne has prepared Amendment C323 to the Melbourne Planning Scheme. The amendment aims to encourage the provision of arts and creative industry along Sturt Street, Southbank in order to support the role of the state significant Melbourne Arts Precinct.

                    The amendment:

                    • introduces the Schedule 7 to the Capital City Zone and rezones the land from Capital City Zone 3 (CCZ3) and General Residential Zone 1 (GRZ1) to the Capital City Zone 7 (CCZ7) on a permanent basis
                    • alters the Urban Design within the Capital City Zone Policy at Clause 22.01
                    • alters Schedule 1 to the Design and Development Overlay at Clause 43.02s01
                    • deletes Schedule 1 to the Parking Overlay and applies Schedule 12 to land previously zoned GRZ1.

                    On 7 March 2018 the Minister for Planning approved Amendment C330, which introduced Schedule 7 to the Capital City Zone on an interim basis.

                    The new Schedule 7 to the Capital City Zone applies to the Melbourne Arts Precinct, in Southbank and includes:

                    • A new purpose to maintain and enhance the Melbourne Arts Precinct as a significant arts and cultural precinct.
                    • A new mix of ‘as of right’ and ‘permissible’ uses which are specifically tailored to the future needs of the Melbourne Arts Precinct and seek to encourage the provision of arts and creative industry uses within the first four storeys of buildings, together with the provision of active street frontages and integration with the public realm.
                    • New application requirements and decision guidelines to guide the use of land to further the purpose of the zone.

                    The additional references to Schedule 7 to the Capital City Zone in Clauses 22.01 and 43.02s01 ensure the urban design policy and the active street frontages requirements continue to apply to the area once rezoned.

                    The substitution of the Schedule 12 with the Schedule 1 of the Parking Overlay is to ensure the parking requirements reflect the rezoning from GRZ1 to CCZ7.

                    All submissions received were considered by the Future Melbourne Committee at its meeting held on 7 August 2018. Subsequently, a panel hearing of an Independent Panel to hear and consider the Amendment was held on 17 and 18 October 2018. The panel delivered its interim report on 3 December 2018 and although supportive of the amendment intent, recommended re-drafting of the planning controls to improve the proposed controls to achieve the outcomes sought. Following the re-notification of the revised planning controls, the panel re-convened on Monday 28 October 2019 to consider the revised amendment and all further submissions received. The panel delivered its final report on 16 December 2019. Amendment C323 was considered by the Future Melbourne Committee on 19 May 2020 and adopted by Council on 26 May 2020.

                    Current status

                    Amendment C323 has been approved by the Minister for Planning on 5 December 2021 and comes into effect on Friday 24 December 2021 with the publication of the notice in the Government Gazette.
